1. AMENDMENTS AND ASSIGNMENTS
We at LinkStack reserves the right to modify this Agreement at any time.
2. GENERAL USE
Users are only permitted to use the SMTP server for their own LinkStack instances. LinkStack is not responsible for any security breaches involved with the use of this service, anyone using this service does so on their own risk and responsibility.
3. ACCEPTABLE USE
Users agree that they will not knowingly use the Service in a manner which significantly and adversely affects the performance or availability to other users of the service, or in a manner that interferes in any way with host computers or network security, or to attempt to gain unauthorized access to any unrelated person’s computer system. Administrators reserve the right to prevent users from using this service if this service is used for malicious purposes or any other harmful way that could cause problems for the entire Service.
User shall immediately notify a system administrator of any security breach in, or unauthorized use of, User’s account.
4. INDEMNIFICATION BY USER
USER AGREES TO INDEMNIFY AND HOLD THE SMTP AND ITS DIRECTORS HARMLESS AGAINST ANY CLAIMS, LIABILITY, DAMAGES, COSTS AND EXPENSES (INCLUDING REASONABLE ATTORNEY’S FEES) ARISING FROM THE USER’S USE OF THE SERVICE OR A VIOLATION OF THIS AGREEMENT. IN PARTICULAR, THE USER ACKNOWLEDGES THAT IT HAS FULL RESPONSIBILITY FOR THE CONTENT OF EACH MESSAGE SENT USING ITS ACCOUNT.
5. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL ANYONE INVOLVED IN THE HOSTING OF THIS SERVICE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE THE SERVICE OR THAT RESULT FROM DEFECTS, MISTAKES, OMISSIONS, INTERRUPTIONS, DELAYS IN OPERATION OR TRANSMISSION, VIRUSES, DELETION OF FILES OR E-MAIL, OR FOR ANY LOSS OF PRIVACY OR CONFIDENTIALITY OF PRIVATE MESSAGES, HOWSOEVER CAUSED.
6. INTERPRETATION AND GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of Germany and the EU.
